Our Mission

Libera Voce’s Mission is three-fold:

  • A return to open and free expression online thus restoring the protection of the First Amendment
  • Protection of online commerce
  • Access for all to legal redress against the abuses of Big Tech

 

Our Goal

THE PROBLEM

Big Tech digital platforms have gained extraordinary power in our society. They control much of the information and marketing in today’s world. There are countless examples of the severe economic damage Big Tech’s conduct causes to individuals and small businesses. And these numbers grow daily!

At any moment, they can decide to cut off a person, or a company’s livelihood. They can shut down sales and all communications. We have even seen them do it undeterred to a sitting President. No one is safe.

This is incredibly dangerous to our democratic republic and to conducting business worldwide.

In 2020, attorney Rachel Rodriguez was hired by a client to seek answers as to why their Twitter following had fluctuated by the thousands. They had spent a significant marketing investment to build a follower base. To date, Twitter has refused to answer their inquiry for data. They have been denied any information. Twitter acts without fear of reprisal…so far.

A few months later, Ms. Rodriguez discussed a similar matter with another prospective client. After the initial consult, the client could not retain Ms. Rodriguez because their business had been decimated by the Big Tech suppression. The client had no financial possibility to retain any counsel and seek damages. That example which clearly showed the severity of damage inflicted by Big Tech led Ms. Rodriguez to seek an avenue for redress.

Compounding this problem, the news media and journalists are acting in concert with Big Tech’s decisions on their platforms, rather than acting as a lever of accountability. All this has made seeking justice outside of the courts and/or legislatures basically impossible.

The need to hold Big Tech accountable and enact reforms is overwhelmingly obvious.

Moreover, the need for restitution for the many individuals and companies financially harmed is very clear and the urgency increases daily.

 

THE SOLUTION

Accountability through individual legal action in the courts or through Congress or state legislatures has, to date, been mostly unavailable.

Aggrieved users and businesses watch their hard work and investment disappear nearly overnight due to unilateral actions by Big Tech platforms. Big Tech has been “protected” by Section 230.

The now well-known “Section 230” or 47 USC 230 from the Communications Decency Act in the 1990s originally provided a way to encourage the growth of the internet. This regulation shielded digital platforms from certain types of liability, specifically arising from third-party user content. As a result of cases testing the protections of Section 230 over the last couple of decades; there appears to be an immutable immunity for Big Tech whim. This was never intended to be the result of the law.

Liability protections in the statute were largely focused on defamation claims against platform providers for content the platforms neither created nor self-published and which platforms did not actively remove. The cases that have created this broad immunity also largely focus only on defamation liability.

Alternatively, the legal protections of the statute for platform removal of content was designed to protect platforms seeking to remove illegal, sexually harmful (to minors) and clearly defamatory conduct, if they so choose.

The law was not enacted to shield platforms from making arbitrary and ever-changing censorship choices to silence alternative viewpoints.

47 USC 230 also does not and never has given Big Tech right to violate any form of agreement or obligation to users without recourse. Big Tech must still abide by its contractual obligations and well-established principles of commercial law and business relationships.

Libera Voce’s goal is to bring restitution to harmed users on Big Tech platforms through a unique approach using commercial liability. We have developed a database of research and resources to help fight this battle. This database expands weekly as we stay abreast of the daily onslaught of Big Tech and add more case information and legal resources to aid in this fight.

We also know that successful claims will begin to bring accountability overall to the current digital marketplace. The more financial pain they feel and the more court precedent that are established, the more they will have to change their behavior.

We also know our success in aiding court battles will provide an information and research treasure trove for legislatures who are looking to reform the law. We will be able to help shape the statutory basis for insuring accountability. We are a critical part in a multi-prong effort to tame the Big Tech beasts without destroying the information economy.

Libera Voce will carefully assess potential claims and assist prospective plaintiffs in gathering the evidence they need to pursue restitution in the courts.

We also will provide prospective plaintiffs with referrals to excellent litigation counsel through our nationwide network of dedicated, passionate and experienced lawyers who either specialize in digital litigation or have a business background that is a fit.

Cases that have been vetted and prepared for referral to our litigator network will be handled exclusively by the attorneys chosen by prospective plaintiffs.

Libera Voce will assist these courageous advocates and plaintiffs to ensure well-developed cases are presented and that they have sufficient resources for the battle against Big Tech’s litigation coffers. Libera Voce is not a law firm and will not directly hire lawyers to represent any prospective plaintiffs.

Moreover, funds permitting, Libera Voce will work to help provide e-Discovery resources and research to lawyers representing plaintiffs pursuing damages in court.

Libera Voce will also build and maintain a legal defense fund for individuals and businesses whose entire financial means to fight against Big Tech conduct have been destroyed.

We want to facilitate any party harmed by Big Tech to obtain the resources they need to retain legal counsel and seek damages in court.

As part of our project, we will build a donor/support base of large and small donors and activists to help bring pressure eventually on the Media and elsewhere to bring about much-needed changes.
